Terms and Conditions

These Terms and Conditions govern the provision of website design, development, and related services by TJ Design. By requesting services, approving a quotation, or making payment, the client agrees to the terms outlined in this document.

1. Acceptance of Terms

By engaging the services of TJ Design, the client confirms that they have read, understood, and agreed to these Terms and Conditions.

These terms apply to all services provided by TJ Design unless otherwise agreed in writing.

2. Quotations and Pricing

All quotations issued by TJ Design are valid for 14 days from the date of issue unless otherwise stated.

Prices may be subject to change if:

  • The scope of work changes

  • Additional features or services are requested

  • Integration with external systems or third-party services is required

  • The client chooses to host the website on their own hosting services

  • The complexity of the project differs from the initial project description

If any of the above circumstances occur, TJ Design reserves the right to issue a revised quotation.

Work outside the originally agreed scope will not begin until the client approves the revised quotation.

3. Deposits and Payment Terms

A 50% deposit is required before any work will commence or continue on a demo website or project.

The deposit is strictly non-refundable as it covers the time, planning, consultation, and design work already invested in the project.

The remaining balance must be paid before the final website is delivered or published.

All payments must reflect in TJ Design’s account before work will begin or continue.

TJ Design reserves the right to pause or suspend work until payments are received.

4. Hosting Services

If TJ Design provides website hosting services, the client acknowledges that:

  • Hosting fees may change depending on the pricing structure of the hosting provider

  • Clients will be informed of any pricing adjustments prior to renewal

If the client chooses to host their website on their own hosting services, TJ Design will not be responsible for:

  • Hosting performance

  • Server configuration issues

  • Hosting downtime

  • Security vulnerabilities caused by the hosting provider

  • Technical limitations of the hosting environment

Additional charges may apply if modifications are required to make the website compatible with third-party hosting environments.

5. Website Updates and Future Work

Once a website has been completed and delivered, any future changes, updates, or modifications will be treated as additional work.

These services will be billed separately depending on:

  • The amount of work required

  • Technical complexity

  • Time required to complete the updates

A quotation or estimate will be provided before additional work begins.

6. Project Timelines

Project timelines depend on several factors including:

  • The client providing all required content such as text, images, and branding materials

  • Timely client feedback and approvals

  • Technical requirements of the project

  • Third-party service integrations

TJ Design will not be held responsible for delays caused by the client or third-party service providers.

7. Client Responsibilities

The client agrees to:

  • Provide accurate and complete information required for the project

  • Supply all necessary content including images, text, and branding materials

  • Ensure that they have the legal rights to use any content supplied

  • Review and approve project milestones within a reasonable timeframe

TJ Design will not be responsible for any legal disputes or copyright issues resulting from content supplied by the client.

8. Scope of Work

The services provided by TJ Design are limited to the scope of work defined in the approved quotation.

Any requests outside of the original scope will be considered additional work and may incur extra charges.

Examples of additional work include but are not limited to:

  • Additional pages not included in the original quotation

  • New features or functionality

  • Design revisions after approval

  • Integration with new third-party systems

  • Additional content uploads

A revised quotation will be issued for any additional work requested.

9. Payment Delays and Suspension of Work

If payments are delayed or not made according to agreed payment terms, TJ Design reserves the right to:

  • Pause or suspend work immediately

  • Delay project timelines

  • Restrict access to the website or services until payment is received

If final payment is not received within 30 days of project completion, TJ Design reserves the right to:

  • Remove the website from hosting services managed by TJ Design

  • Disable access to the website

  • Withhold website files or transfer of ownership

10. Intellectual Property and Ownership

All design concepts, layouts, code, and development work remain the intellectual property of TJ Design until full payment has been received.

Once the project has been paid in full, the client receives the rights to use the completed website.

TJ Design retains the right to display completed work in:

  • Portfolios

  • Marketing materials

  • Social media

  • Promotional content

unless otherwise agreed in writing.

11. Third-Party Services

Websites may rely on third-party services including but not limited to:

  • Hosting providers

  • Domain registrars

  • Plugins and software extensions

  • Analytics tools

TJ Design does not control these services and cannot guarantee their continued availability or performance.

12. Limitation of Liability

TJ Design will not be held liable for:

  • Loss of revenue, business, or profits

  • Website downtime caused by hosting providers

  • Security breaches caused by third-party software or plugins

  • Technical issues resulting from modifications made by the client or third parties

The client acknowledges that no website can be guaranteed to be completely secure or error-free.

13. Abandoned Projects

If the client fails to respond, provide required information, or approve project progress for 30 days or more, the project may be considered abandoned.

In such cases:

  • The project demo website may be removed or taken offline

  • The deposit remains non-refundable

If the client wishes to continue the project after it has been paused or removed, additional charges may apply depending on the work required to restore or restart the project.

TJ Design reserves the right to issue a new or revised quotation before resuming any work.

14. Termination of Services

TJ Design reserves the right to suspend or terminate services if:

  • Payments are not made according to agreed terms

  • The client engages in abusive, threatening, or unreasonable behaviour

  • The client fails to provide required project information

Deposits remain non-refundable in such circumstances.

15. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Republic of South Africa.
